Terms and Conditions

These Terms and Conditions govern your use of the KJ Creative website and client portal (kjcreative.com), operated by Kerwyn Joseph, trading as KJ Creative, in Trinidad and Tobago. By using this website, you agree to these terms.

Website use

Content on this website is provided for general information about KJ Creative’s services and is not a guarantee of price, availability, or outcome for any specific project. Package listings, starting prices, and estimates shown on this site are indicative and subject to confirmation in a written proposal.

Project agreements

Engaging KJ Creative for a project (website design, branding, photography, videography, or any other service) is governed by the specific proposal, quotation, and/or contract issued for that project, not solely by this website. Where these Terms and a signed project agreement conflict, the signed project agreement controls for that project.

Pricing and payment

All prices are quoted in Trinidad and Tobago Dollars (TTD). Projects typically require a deposit to confirm booking, with the remaining balance due according to the payment schedule in your proposal or invoice. Payments may be made via the payment link provided or by bank transfer; receipts uploaded for bank transfers are verified by our team before an invoice is marked as paid.

Client portal accounts

If you create a client portal account, you’re responsible for keeping your login credentials confidential and for activity that occurs under your account. Notify us immediately if you believe your account has been accessed without authorization.

Revisions and additional work

Included revisions vary by package or service and are set out in your proposal. Work requested beyond the agreed scope is treated as additional and will be quoted and confirmed with you before any extra billing or additional work begins.

Intellectual property

Unless otherwise agreed in writing (such as a full rights transfer or copyright buyout), KJ Creative retains ownership of original creative work, including design files, source files, and photography/videography, and grants clients a license to use delivered materials for their intended business purpose. KJ Creative may display completed work in its portfolio and marketing materials unless a client has requested confidentiality in writing.

Cancellations

Cancellation, rescheduling, and refund terms are specific to each service and are set out in your project agreement or booking confirmation.

Limitation of liability

To the fullest extent permitted by law, KJ Creative’s liability for any claim arising from these Terms or a project is limited to the amount paid for that project. KJ Creative is not liable for indirect or consequential losses.

Governing law

These Terms are governed by the laws of the Republic of Trinidad and Tobago, and any dispute is subject to the exclusive jurisdiction of the courts of Trinidad and Tobago, without prejudice to any dispute resolution process set out in a specific project agreement.

Changes to these terms

We may update these Terms from time to time. Continued use of the website after changes are posted constitutes acceptance of the updated Terms.
